Rawle & Henderson LLP is pleased to announce that Robert A. Fitch has been named a 2015 New York Metro Super Lawyer by the publishers of Law & Politics. Super Lawyers selects attorneys each year for recognition through a rigorous nomination process that includes peer review by practice area and independent research on candidates. Only the top 5% of the lawyers in the New York metro area are chosen annually for this honor. Bob was also selected as a Super Lawyer in 2007, 2013 and 2014. He is the resident partner in the Rawle & Henderson LLP New York office. Bob concentrates his practice in the defense of architects and engineers, construction, medical and oral surgery malpractice claims, and commercial motor vehicle litigation. He received his undergraduate degree from Syracuse University and his J.D. from Syracuse University College of Law. He is admitted to practice in New York since 1974, as well as in federal courts in Southern, Eastern and Northern Districts of New York and the Second Circuit Court of Appeals. He has tried over 100 cases to verdict and is a member of the Defense Research Institute, Federal Bar Council, PIAA and Trucking Industry Defense Association. James Modzelewski, a partner in the Long Island office of Rawle & Henderson LLP, has been selected as a 2015 New York Super Lawyer.   James focuses his practice on defending health care professionals—including dentists, oral surgeons and physicians—in malpractice matters and defending general liability matters.  He has over 15 years of experience in these areas and handles all phases of civil litigation, including trials, as well as alternative dispute resolution. James also has considerable appellate experience, including appeals in the New York Supreme Court Appellate Division in the First, Second and Third Departments, and the Second Circuit Court of Appeals.  James earned his J.D. from St. John’s University School of Law in 1998 and his B.A. in Political Science from the University at Albany in 1995.  He was also chosen as a New York Super Lawyer in 2014.

IARP CONFERENCE, ATLANTIC CITY

Richard J. Sexton, Of Counsel in our Philadelphia office, participated in the 16th Annual Pennsylvania and New Jersey Chapters of the International Association of Rehabilitation Professionals (IARP) Conference in June 2015 at the Tropicana Casino & Resort in Atlantic City, New Jersey. Richard co-presented two sessions: The Defense of Personal Injury: When, Why & How to Use the Vocational Expert and The Personal Injury Trial: Be the Judge and Jury. IARP serves rehabilitation professionals through education, professional development and networking opportunities. IARP’s membership includes individuals practicing in the fields of long-term disability and disability management consulting, case management and managed care, forensics and expert testimony, life care planning, and Americans with Disabilities Act (ADA) consulting.

Richard Sexton focuses his practice primarily in the areas of commercial motor vehicles, premises and product liability, employment and insurance coverage law. He has substantial trial experience in complex personal injury, commercial litigation and general defense matters. In recognition of his experience in litigation, he was selected to serve as a court-appointed arbitrator by the New Jersey Superior Court. He has also written and lectured on a wide variety of topics including a recent seminar presentation entitled New Jersey Auto Insurance PIP Law. Mr. Sexton graduated from the United States Naval Academy with a B.S. in 1981 and a J.D. from Rutgers University School of Law in 1990. He has 24 years of combined service in the United States Navy, including active and reserve duty, achieving the rank of Lieutenant Commander. During his active duty, he served aboard the U.S.S. Enterprise for four years. He is admitted to practice in the state and federal courts of Pennsylvania and New Jersey as well as the U.S. District Courts for the State of New Jersey and the Eastern District of Pennsylvania, the U.S. Court of Appeals for the Third Circuit and the U.S. Supreme Court.

Rawle & Henderson LLP was ranked 98th, with 158 employees in its three local offices in Philadelphia, Marlton and Wilmington. PA. RISING STAR; ACBA SECTION COUNSEL

David R. Chludzinski, an associate in our Pittsburgh office, has been selected for the fourth year in a row as a Pennsylvania Rising Star by Super Lawyers and Law & Politics Magazine. He was also chosen as a Rising Star in 2012, 2013 and 2014. Rising Stars are the top 2.5 percent of attorneys in Pennsylvania who are 40 years old and younger or have been in practice for 10 years or less. In addition, David was elected in June 2015 to a three-year term on the Allegheny County Bar Association’s Civil Litigation Section Council.

David concentrates his practice on the defense of commercial motor vehicles and their insurers. David earned his law degree from the Dickinson School of Law at Penn State University. While attending law school, he was a Comments Editor on the International Law Review and he received the C.A.L.I. Award for advanced pre-trial advocacy. He earned his B.A., cum laude, from Boston College. David is admitted to practice in Pennsylvania and in the U.S. District Courts for the Eastern, Middle, and Western Districts of Pennsylvania.

ABA TIPS COMMITTEE; LORMAN WEBINAR

Zachary M. Rubinich, a partner in our Philadelphia office, was recently appointed as a Vice-Chair for the American Bar Association’s Tort Trial and Insurance Practice (TIPS) Workers’ Compensation and Employers’ Liability Law Committee for 2015-2016. He served as a member of the Workers’ Compensation and Employers’ Liability Law Committee for 2014-2015. In addition, Zach presented a Lorman Education Services webinar on Work-Related Stress Claims: Overview, the Law and Strategies for Defense in July 2015. He focused on how companies can protect themselves from workplace stress claims, one of the fastest growing segments of the workers’ compensation system over the past several years. The webinar addressed the numerous issues which arise during the investigation, prevention, litigation, mitigation and resolution of stress claims. It focused on the legal burdens of proof, types of stress claims,  available benefits, litigation tactics and reduction of claim costs.

Zach focuses his practice on the defense of insurance carriers, self-insured entities and third-party administrators against workers’ compensation claims in Pennsylvania. Based on his extensive experience, the Pennsylvania Bar Association Workers’ Compensation Law Section has certified him as Specialist in the practice of workers’ compensation law. Zach has handled all aspects of litigation before workers’ compensation judges, the Workers’ Compensation Appeal Board, the Commonwealth Court and the Pennsylvania Supreme Court. He routinely counsels employers, insurance carriers and third party administrators on claims management, workplace safety, return-to-work programs, employment practices and risk management. Zach is rated AV Preeminent by Martindale-Hubbell. He has been selected as a Pennsylvania Rising Star by Super Lawyers from 2010 to 2014. Eric K. Falk, a partner in the Pittsburgh office, had a six-week showing of his photography this summer at the Rivers Club in Pittsburgh.  Eric is an avid amateur photographer who is particularly interested in natural and man-made architecture. He focuses his practice on defending companies in toxic tort litigation.  He is currently a member of the DRI Toxic Tort Committee and is a former chair of the DRI Industrywide Litigation Committee.  He received his J.D. in 1984 from the University of Pittsburgh School of Law and his B.S. with Honors in 1981 from the American University in Washington, D.C.  He is admitted to practice in Pennsylvania and West Virginia as well as the U.S. District Court for the Western District of Pennsylvania, the U.S. District Courts for the Southern and Northern Districts of West Virginia, and the U.S. Court of Appeals for the Fourth Circuit.  He was selected as a 2013 Top Rated Lawyer in Mass Torts by Martindale-Hubbell, and he has been rated AV Preeminent by Martindale-Hubbell from 2005 to 2015.
