Zachary Rubinich, a Partner in our Philadelphia, PA office, moderated and participated in a panel discussion during ABA TIPS Workers’ Compensation and Employers’ Liability Mid-Winter Conference held in New Orleans, LA on March 4, 2022. Mr. Rubinich’s panel was entitled “The Interplay of Admiralty Law and State Workers’ Compensation Issues.” Mr. Rubinich, a past Chair of the ABA TIPS Workers’ Compensation Committee, was joined by three other prominent trial attorneys and one insurance industry professional to address ‘The Longshore And Harbor Workers’ Compensation Act’, ‘The Defense Base Act’, ‘The Jones Act’ and various state workers’ compensation statutes. The panel provided an analysis of the various types of injuries, classification of workers, the available benefits, trial tactics, and exposure and settlement evaluation strategies. The panel also examined ethical issues involving employees who sustain injuries arising out of commerce on or over navigable waters in the United States or in the adjoining areas.
