Rawle and Henderson is pleased to announce that Robert Fitch, a partner in our Wall Street office, successfully obtained a defense verdict on October 29, 2020 in the first case to be tried in the New York Supreme Court for West Chester County after the COVID-19 shutdown. Mr. Fitch successfully defended an oral surgeon facing malpractice claims arising out of a tooth extraction and placement of a dental implant that allegedly caused permanent facial nerve injuries. While each trial attorney, both parties (i.e. the plaintiff and the defendant) and the six jurors appeared in the courtroom during the week long trial, key witnesses, including all experts testified remotely. The jury reached a unanimous verdict in favor of Rawle’s client after just two hours of deliberation.
