For the second time in just 30 days, Rawle & Henderson Partner Maryanne Kolenovsky successfully obtained a defense verdict in a dental malpractice case. Her latest victory occurred on May 4th, in the New York State Supreme Court for Orange County. The jury returned a defense verdict in favor of her dentist client and his practice after just 80 minutes. This follows her success in a Nassau County court in April.
The plaintiff alleged that the dentist failed to properly diagnose a dental abscess, leading to an infection that required hospitalization, surgery and intravenous antibiotics. Plaintiff also claimed that the dental practice failed to properly respond to phone calls regarding the worsening symptoms, which led to a sepsis infection. While the jury found the practice was negligent, they found that it was not a substantial factor in causing the plaintiff’s injuries, leading to a verdict for both defendants.
When surveyed after the verdict, the jury said Ms. Kolenovsky and her team was organized and thorough, had credible expert witnesses and a summation that nicely pulled the legal concepts and testimony together.
