Philadelphia, PA (November 27, 2024) – Rawle & Henderson LLP congratulates its’ partner Zachary M. Rubinich on his article entitled Workers’ Compensation Injuries due to a Condition of the Premises or Operation of the Business, which appeared in the Labor and Employment/Workers’ Compensation Special Section of ALM’s The Legal Intelligencer on November 8th.

Mr. Rubinich’s article focused on Section 301(c)(1) of the Pennsylvania Workers’ Compensation Act, which provides that there are two situations where an injury can be considered to have occurred during  the course of employment and thus eligible for workers compensation. One of the situations occurs when an employee engaged in work is alleged to have been injured by a condition of the premises or the employer’s business operations.

Mr. Rubinich analyzed several cases where an injury was found to have been caused by a condition of the premises.  Mr. Rubinich also reviewed and discussed cases where a condition of the employer’s premises was deemed not to have played a role in causing the claimant’s injuries. Finally, Mr. Rubinich provided employers with guidance to safeguard employees from the potential of workplace injuries on their premises, and identified and discussed several potential legal defenses to workplace premises litigation.
