Philadelphia Partner Catherine Walto Obtains Summary Judgment Dismissal of Defamation Case for Clients in a Family Feud

Philadelphia, PA (April 4, 2024) – Partner Catherine Walto, with the assistance of associate Jennifer Lawson, obtained summary judgment on all claims for her clients in a defamation case in the Court of Common Pleas for Philadelphia County.  The case involved a disagreement between three brothers and their wives, with plaintiff claiming that two of his brothers and their spouses had defamed him and engaged in other tortious conduct arising out of statements made by the defendant brothers.  Ms. Walto represented one of the brothers and his wife.

After repeated discovery motions where Orders were entered against plaintiff for his failure to produce documents proving his claimed damages and participate in discovery, Judge Denis Cohen entered an Order that precluded plaintiff from presenting evidence of economic and noneconomic damages at trial.  This preclusion Order served as the basis for Ms. Walto’s Motion for Summary Judgment.  Plaintiff opposed the Motion, claiming genuine issues of fact regarding damages incurred by him existed and that Summary Judgment was inappropriate.  The Court ultimately dismissed all of plaintiff’s claims again Ms. Walto’s clients, with prejudice.
