New York City, NY (March 5, 2026) – Anthony D. Luis, a Partner in the Firm’s New York City office, with Harold Lee, Of Counsel in the Firm’s New York City office as second chair, obtained a unanimous defense verdict following a jury trial in a Dental Malpractice case in New York County Supreme Court. The matter was defended on behalf of their client, a general dentist who practiced in New York City for over 45 years.
The plaintiff alleged the client departed from accepted standards of dental care in connection with his evaluation and treatment of a lower right molar. Specifically, the plaintiff claimed the client failed to properly diagnose periapical pathology associated with a hairline crack in the molar and allegedly negligently placed a crown over the affected tooth, which plaintiff claimed resulted in the development of an abscess on the gumline.
At trial, Mr. Luis established that his client’s care and treatment were, at all times, consistent with accepted standards of general dentistry. The evidence demonstrated that upon identifying a hairline crack in the molar, the client appropriately placed a permanent crown utilizing temporary cement and properly referred the plaintiff to an endodontist for further evaluation and potential root canal therapy. Mr. Luis further established the plaintiff did not present to the endodontist as recommended and subsequently developed an abscess at the gumline approximately two months later.
Through expert testimony and cross-examination of the plaintiff’s witnesses, Mr. Luis demonstrated that diagnostic assessment, treatment, and referral were clinically appropriate and within the standard of care expected of a reasonably prudent general dentist under similar circumstances.
Following presentation of the evidence and summations, the jury returned a unanimous defense verdict in favor of the client after approximately 45 minutes of deliberation. The jury specifically determined that the client did not depart from the applicable standard of care and was not liable for the injuries alleged.
The client’s liability insurance carrier is MLMIC, the largest writer of medical professional liability insurance in the State of New York.
