Hackensack, NJ (March 6, 2025) – February was a winning month for Rawle & Henderson’s Of Counsel Laurie P. Beatus, who obtained summary judgments on both sides of the Hudson River, in two personal injury cases.
In the New Jersey case. Ms. Beatus obtained summary judgment in Morris County Superior Court dismissing the claims of a plaintiff who alleged significant neck and lower back injuries in a slip-and-fall allegedly caused by liquid on the floor of a supermarket’s produce department. Through discovery, Ms. Beatus was able to exclude any viable claim of actual or constructive notice of the liquid on the floor. While plaintiff’s counsel argued that the supermarket’s mode of operation made the accident foreseeable, Ms. Beatus prevailed by arguing that the absence of any nexus between the store’s operation and the presence of the liquid on the floor warranted dismissal of the case.
In the New York case, Ms. Beatus also obtained summary judgment in a personal injury case in the New York Supreme Court of Suffolk County involving a patron who was allegedly injured by a defect in a nearby parking lot used by the restaurant’s customers. Ms. Beatus secured dismissal of the claims against the restaurant by proving that the owner of the parking lot (and not the restaurant) was solely responsible for the maintenance and condition of the area where the injury allegedly occurred.
