New York, NY (September 11, 2023) – Rawle & Henderson Partner Richard B. Polner obtained a Summary Judgment in New York Supreme Court, Kings County, on September 6, 2023 on behalf of his client, a Brooklyn plumbing contractor, for allegedly creating a roadway that resulted in Plaintiff being thrown from a bicycle.
Mr. Polner filed a pre-discovery Summary Judgment that conclusively established that the client played no role in the cause or creation of the defective roadway that allegedly resulted in Plaintiff’s fall.
The Court held that the plumbing contractor should not be held liable, as it was established through documentary evidence that it exclusively performed work within the property line of a home approximately four houses away from the location of the alleged defect. The Summary Judgment motion was made pre-deposition and was granted over the Plaintiffs’ opposition.
Rawle Associate Ramzy M. Dawoud argued the motion in Court and was integral in securing the Summary Judgment decision.
