New York Attorney Stephen Levy Obtains Summary Judgment in New York County for Property Clients

New York, NY (August 29, 2024) – Rawle & Henderson Of Counsel Stephen J. Levy and a team from the firm’s New York City office obtained summary judgment in the Supreme Court for New York County in a slip-and-fall case against Rawle’s clients, a property owner and management company.

Plaintiff alleged that he tripped and fell on a sidewalk adjacent to the property that Rawle’s clients owned and managed, which he claimed was caused by both broken concrete surrounding a steel diamond plate vault cover and a failure to clear snow and ice.

Mr. Levy successfully argued that only the New York Transit Authority, as the owner of the plate, had a duty to clear the ice and snow and to keep the adjacent sidewalk free from defects.

The Court granted the motion for Summary Judgment in its entirety. Plaintiff was seeking $900,000 in damages for a fracture and other serious injuries to his right arm and wrist.  He received nothing.

Mr. Levy was assisted by Administrative Assistant Lisa Hailey and Paralegal Danielle Kuchinskas.
