Another Defense Verdict for William Spiegel on behalf of Oral Surgeon Client in a Highly Contested Dental Malpractice Trial

New York, NY (September 15, 2025) – New York partner William S. Spiegel obtained a unanimous defense verdict in the New York Supreme Court for Dutchess County on behalf of an oral surgeon in a highly contested dental malpractice trial. And in an unusual move, plaintiff also claimed a breach of contract, which was allegedly a specific promise by the oral surgeon for a curative result that was allowed to be presented to the jury.

The plaintiff filed suit because of unhappiness with the results of the oral surgeon’s full mouth extractions, bone grafting, full mouth implants and prosthetics restorations on both jaws.

The plaintiff also claimed that the oral surgeon’s work was negligently performed, which purportedly led to serious and permanent physical and emotional injuries, and caused him to incur significant financial losses.

After hearing testimony from both plaintiff’s and defendant’s expert witnesses, the jury deliberated for two days and concluded that the oral surgeon was honest and credible, and delivered a unanimous defense verdict.

The plaintiff initially demanded $1 million dollars, but dropped the demand to $500,000 in their summation to the jury.

New York partner Robyn S. Goldfarb provided invaluable assistance with the case.
