Philadelphia, PA (September 29, 2025) – Zachary M. Rubinich, a partner in Rawle & Henderson’s Philadelphia office, has obtained two Termination Petitions for his client, a security services company, in a case finding an injured worker fully recovered from both orthopedic and neurological work-related injuries sustained in 2018.
After almost two and a half years of litigation, Mr. Rubinich succeeded in terminating the injured worker’s entitlement to continue receiving workers’ compensation medical benefits. As a result of that ruling, his client was entitled to seek reimbursement from the Pennsylvania Supersedeas Fund for all workers’ compensation benefits that were overpaid to their employee from September of 2023 to the present.
Mr. Rubinich presented testimony from a Board-Certified orthopedic spine surgeon demonstrating that the injured worker had fully recovered from her both cervical and lumbar spinal injuries. Additionally, Mr. Rubinich presented testimony from a Board-Certified neurologist to establish that the injured worker had also fully recovered from her neurological injuries.
The Workers’ Compensation Judge found Mr. Rubinich’s medical experts credible and persuasive, concluding that the injured worker had fully recovered from spinal and neurological injuries, and that there was no need for additional treatment.
Further, the Workers’ Compensation Judge rejected the injured worker’s chiropractic expert, finding that none of the chiropractic treatment was reasonable or necessary since the work-related injury had fully resolved.
