In a precedential decision that could potentially impact every Compromise & Release Settlement Agreement under the Pennsylvania Workers' Compensation Act, the Commonwealth Court in the case Armour Pharmacy v. Bureau of Workers’ Compensation Fee Review Hearing Office (National Fire Insurance Company of Hartford) (No. 1613 C.D. 2017) (decided August 7, 2018), has ruled that "The parties to a Compromise and Release Agreement can bind each other, but they cannot release themselves from liability to a person who is not a party to the C&R agreement and who has been given neither notice nor opportunity to be heard on the C&R Agreement."

Workers’ Compensation News: PA Introduces Guidelines for Safe Prescribing of Opioids in WC Matters

On July 16, 2018, Pennsylvania Governor Tom Wolf introduced guidelines for safe prescribing of opioids in workers’ compensation matters. The opioid prescribing guidelines are intended to supplement and not replace clinical judgment for health care providers concerning treatment of patients with work-related injuries. The guidelines acknowledge that opioids have been over-used for the treatment of both acute and chronic pain.

PA Superior Court Affirms Validity of Exculpatory Clause in Gym Membership Agreement

On May 4, 2018, a three-judge panel of the Pennsylvania Superior Court issued an unanimous Opinion affirming the trial court’s order granting summary judgment to Fitness International, LLC, et al. (“L.A. Fitness”) in a lawsuit filed by an L.A. Fitness member for personal injuries the member allegedly sustained at an L.A. Fitness facility as she walked from the swimming pool to the showers adjacent to the pool.

Summary judgment in premises liability case involving asbestos exposure claim

John C. McMeekin II and Susan M. Dean obtained summary judgment on behalf of a premises owner where plaintiff alleged that decedent was exposed to asbestos at various industrial facilities while employed by an independent contractor. In a premises liability case, plaintiff bears the burden of proof to establish an exception to the general rule that the premises owner/operator has no duty to warn an independent contractor or his employer of a condition that was as obvious to them as it was to the land owner/operator.

While a Pennsylvania Supreme Court decision in an individual’s area of practice is always exciting, for child welfare attorneys, the momentous nature is heightened because decisions are infrequent. Child welfare attorneys are attorneys who, in Philadelphia and across the commonwealth, represent county children and youth agencies (e.g., Philadelphia’s Department of Human Services), parents, or children in Juvenile Act hearings, known as dependency proceedings, see 42 Pa.C.S.A. Section 6301 et seq., and in termination of parental rights (TPR) cases under the Adoption Act. (See 23 Pa.C.S.A. Section 2313(a).)

On June 20, 2017, the Pennsylvania Supreme Court issued a landmark Opinion in Protz v. WCAB (Derry Area School District) declaring that the Impairment Rating Evaluation (IRE) provision in Section 306(a.2) of the Workers’ Compensation Act was unconstitutional in its entirety.

Supreme Ct Further Limits Exercise of Personal Jurisdiction in Bristol-Myers Squibb v CA Superior Ct

The United States Supreme Court handed down its latest opinion yesterday reigning in the improper exercise of personal jurisdiction over out-of-state corporations in Bristol-Myers Squibb Co. v. Superior Court of California, San Francisco County, et al. This opinion makes it abundantly clear that the exercise of personal jurisdiction is limited and must comport with a narrow determination of due process.

Supreme Ct. Affirms Limitations on Exercise of Personal Jurisdiction, Due Process in BNSF v. Tyrrell

In the recent decision in BNSF Railway Co. v. Tyrrell, the United States Supreme Court further confirmed that states lack the power to hail foreign corporations, even those conducting substantial business within a state, to court as defendants for allegations unrelated to that corporation’s activities in the forum state. Affirming and expanding on its landmark holding in Daimler, the Court reversed the exercise of general jurisdiction by Montana over a foreign corporation railroad.
